La reconnaissance expresse par une personne de sa dette à l'égard d'une autre et matérialisée par une convention fixant un échéancier de paiement ayant connu un commencement d'exécution est certaine liquide et exigible. C'est donc par une fausse application qu'une cour d'appel a subordonné les conditions de certitude, de liquidité et d'exigibilité d'une créance à la simple contestation du débiteur, non pas sur ces caractères, mais seulement sur le montant de la créance, exposant ainsi son arrêt à la cassation.
Sur l'évocation et pour les mêmes motifs, la décision rendue sur opposition doit être confirmée en toutes ses dispositions.

On Monday 14 April 2025, the OHADA Permanent Secretariat welcomed to its Headquarters in Yaoundé (Cameroon) students of the Master Programme in International Litigation of the Institute of International Relations of Cameroon (IRIC) and a delegation of the OHADA Club of the same Institute.
