En l'état actuel du dossier, le Tribunal ne possède pas des éléments d'appréciation suffisants pour se prononcer sur l'ouverture d'une procédure collective d'apurement du passif. Dès lors, conformément à l'article 32 AUPCAP, il y a lieu de designer un expert à charge pour lui de dresser un rapport sur la situation et les agissements du débiteur et la proposition du concordat faite par lui.
Par ailleurs, la déclaration de cessation de paiement n'ayant pas été faite conformément aux dispositions de l'article 25 AUPCAP, il convient d'ordonner la régularisation de la présente procédure.

On Monday 14 April 2025, the OHADA Permanent Secretariat welcomed to its Headquarters in Yaoundé (Cameroon) students of the Master Programme in International Litigation of the Institute of International Relations of Cameroon (IRIC) and a delegation of the OHADA Club of the same Institute.
