Droit Commercial General - Saisie-attribution - Opposition - Delai De Reclamation De Paiement

Faisant grief à l'ordonnance querellée de n'avoir pas ordonné de lui reverser les sommes qu'il a saisies entre les mains d'une banque, l'appelant :1) apporte au juge d'appel la preuve de la reconnaissance de sa créance par la partie adverse ; 2) établit par acte extrajudiciaire la détention par la banque de sommes suffisantes pour le compte de son débiteur ; 3).demande l'infirmation de l'ordonnance.

En effet, aux termes de l'article 128 alinéa 2 AUDCG, il appartient au créancier opposant de faire constater sa créance et d'obtenir le paiement. La Cour d'appel lui a donné gain de cause infirmant l'ordonnance entreprise et en ordonnant en sa faveur le reversement de la somme mentionnée dans le procès verbal de saisie-attribution.

International Congress on the Business Climate in Africa: Kinshasa to Host Inaugural Edition in 2026
