Injonction De Payer - Ordonnance - Opposition - Formalités - Non Respect- Défaut De Production De L'original De L'assignation - Opposition Irrecevable
Le débiteur qui forme une opposition à une ordonnance d'injonction de payer doit produire l'original de l'assignation devant la juridiction compétente sous quinzaine. Faute pour lui de satisfaire à ces prescriptions légales, son action sera déclarée irrecevable par la juridiction compétente et à défaut de rapporter la preuve d'avoir produit l'original de l'assignation en instance, la Cour d'appel est fondée à confirmer la décision du premier juge.
