La juridiction compétente pour statuer sur toute contestation relative à une opération de saisie-vente est le Président de la juridiction dont émane la décision attaquée siégeant en tant que juge du contentieux de l'exécution. Saisi d'une telle contestation, le juge des référés doit se déclarer incompétent ratione materiae et renvoyer le demandeur à l'action à mieux se pourvoir en saisissant le juge du contentieux de l'exécution compétent.
