La Cour d'Appel du lieu de situation d'un tribunal arbitral est compétente pour connaître du recours en annulation d'une sentence arbitrale rendue par ce tribunal.
Le requérant ne saurait, pour obtenir l'annulation de la sentence arbitrale, exciper avec succès la violation par le tribunal arbitral du principe du contradictoire alors que régulièrement assigné, il ne s'est pas fait représenter.
Dès lors que le requérant n'apporte aucun élément nouveau à l'appui de la demande d'annulation d''une sentence arbitrale pour absence de motivation et qu'il ressort des éléments de la cause que la sentence rendue a bien été motivée, il y a lieu de confirmer ladite sentence en rejetant la demande d'annulation.

On Monday 14 April 2025, the OHADA Permanent Secretariat welcomed to its Headquarters in Yaoundé (Cameroon) students of the Master Programme in International Litigation of the Institute of International Relations of Cameroon (IRIC) and a delegation of the OHADA Club of the same Institute.
This event, organised by the Department of Business Law of the Faculty of Law and Political Science of the said University, was enriched by five presentations. First to take the floor during the proceedings was Dr. Alexis NDZUENKEU, head of OHADA delegation. He addressed participants in English on the following topic: “OHADA and its Institutions: a Guarantee of Economic Growth in Africa”.
