S'agissant de dommages et intérêts il n'y a aucune urgence, aucun péril, à plus forte raison aucune absolue nécessité, justifiant l'octroi de l'exécution provisoire de la décision intervenue, ce d'autant plus que le créancier n'a pas justifié du versement d'une caution conformément aux textes en vigueur.
Par ailleurs, l'article 32 AUPSRVE ne peut recevoir application en l'espèce, les saisies ayant été opérées alors même que le créancier n'ignorait pas l'existence de l'assignation en référé qui lui a été servie avant le commencement de l'exécution. En effet, il ne s'agit pas d'interrompre une exécution commencée mais d'interdire une exécution commencée en fraude de la loi ; il y a lieu en conséquence d'ordonner la défense à exécution provisoire du jugement du tribunal.

On Monday 14 April 2025, the OHADA Permanent Secretariat welcomed to its Headquarters in Yaoundé (Cameroon) students of the Master Programme in International Litigation of the Institute of International Relations of Cameroon (IRIC) and a delegation of the OHADA Club of the same Institute.
This event, organised by the Department of Business Law of the Faculty of Law and Political Science of the said University, was enriched by five presentations.
