Le bénéficiaire d'une cession de fonds de commerce est lié au bailleur de l'immeuble dans lequel le fonds acquis est exploité par le contrat de bail conclu par le cédant. Il ne peut donc dénier au bailleur la qualité pour agir en expulsion.
L'action en expulsion du locataire indélicat doit impérativement, conformément à la réforme de l'AUDCG du 15 décembre 2010, être portée devant la juridiction statuant à bref délai en l'occurrence le juge des référés territorialement compétent.
En matière de bail à usage professionnel, le locataire est tenu de respecter la destination du bail. Tout changement d'activités entrepris par le locataire sans l'accord préalable et exprès du bailleur est un motif de résiliation de son bail et légitime son expulsion de l'immeuble loué.
