En condamnant le demandeur au pourvoi à payer sa dette, la Cour d'appel n'a nullement violé l'article 1111 du Code civil, dès lors que c'est de toute liberté qu'il a ratifié la reconnaissance de dette et que la contrainte n'était pas de nature à lui inspirer la crainte d'exposer sa personne ou sa fortune à un mal considérable et présent.
En ne soutenant pas devant la Cour d'appel que le créancier ne pouvait pas procéder au recouvrement de sa créance selon la procédure d'injonction de payer, le moyen pris de la violation de l'article 1er AUPRSVE doit être déclaré irrecevable, car présenté pour la première fois devant la Cour suprême.

On Monday 14 April 2025, the OHADA Permanent Secretariat welcomed to its Headquarters in Yaoundé (Cameroon) students of the Master Programme in International Litigation of the Institute of International Relations of Cameroon (IRIC) and a delegation of the OHADA Club of the same Institute.
This event, organised by the Department of Business Law of the Faculty of Law and Political Science of the said University, was enriched by five presentations. First to take the floor during the proceedings was Dr. Alexis NDZUENKEU, head of OHADA delegation.
