Un créancier, ayant déjà délaissé deux commandements aux fins de saisie immobilière auxquels la caution hypothécaire a formé opposition dans le cadre d'une procédure au fond au motif que le créancier ne dispose pas d'un titre exécutoire, ayant abouti à un jugement, en décidant ainsi, n'est pas fondé à initier un troisième commandement. Dès lors, ce dernier commandement aux fins de saisie immobilière, identique aux précédents, ne peut produire effet à l'égard de la caution. Il doit être regardé comme un acte sans objet.
