La créance dont le recouvrement est poursuivi a bien une cause contractuelle, dès lors que s'agissant d'une créance de loyers résultant d'un contrat de bail implicitement prorogé d'un commun accord par les cocontractants, loyers échus et au montant chiffré outre les intérêts de droit et frais.
Une telle créance remplissant les conditions de certitude, de liquidité et d'exigibilité, c'est en violation de l'article 1er que la Cour d'appel a confirmé le jugement entrepris.
Par conséquent, son arrêt encourt la cassation, le jugement entrepris doit être annulé et l'ordonnance d'injonction de payer doit sortir son plein et entier effet.

On Monday 14 April 2025, the OHADA Permanent Secretariat welcomed to its Headquarters in Yaoundé (Cameroon) students of the Master Programme in International Litigation of the Institute of International Relations of Cameroon (IRIC) and a delegation of the OHADA Club of the same Institute.
