La saisie conservatoire suivie d'enlèvement immédiat du bien saisi, doit être annulée, dès lors qu'elle a été pratiquée par un agent non qualifié.
Il en est ainsi de la saisie conservatoire pratiquée par un conseil juridique, bien que le procès-verbal ait été signé par un huissier de justice.
Par conséquent, il y a lieu d'ordonner la restitution du bien au demandeur sous astreinte comminatoire.

On Monday 14 April 2025, the OHADA Permanent Secretariat welcomed to its Headquarters in Yaoundé (Cameroon) students of the Master Programme in International Litigation of the Institute of International Relations of Cameroon (IRIC) and a delegation of the OHADA Club of the same Institute.
This event, organised by the Department of Business Law of the Faculty of Law and Political Science of the said University, was enriched by five presentations. First to take the floor during the proceedings was Dr. Alexis NDZUENKEU, head of OHADA delegation. He addressed participants in English on the following topic: “OHADA and its Institutions: a Guarantee of Economic Growth in Africa”.
