Compétence De La Ccja - Hypothèque - Affaire Soulevant Des Questions Relatives à Un Acte Uniforme - Compétence De La Ccja - Annulation De La Décision De La Cour Suprême Nationale
La CCJA est compétente pour un litige relatif à l'hypothèque autorisée par le Président d'un TGI et dont une cour d'appel a statué sur la validation et a décidé, à la fois, le maintien de l'intégralité et de la conversion en hypothèque judiciaire définitive qui sous-tend la condamnation pécuniaire. Dans ces conditions, le contrôle de la régularité procédurale dont se prévaut la Cour Suprême nationale pour retenir sa compétence ne saurait primer sur son obligation de s'assurer au préalable de sa compétence rationae materiae. C'est donc à tort qu'elle s'est déclarée compétente pour examiner le pourvoi en cassation ; sa décision attaquée est réputée nulle et non avenue en application des dispositions de l'article 18 du Traité OHADA.

On Monday 14 April 2025, the OHADA Permanent Secretariat welcomed to its Headquarters in Yaoundé (Cameroon) students of the Master Programme in International Litigation of the Institute of International Relations of Cameroon (IRIC) and a delegation of the OHADA Club of the same Institute.
This event, organised by the Department of Business Law of the Faculty of Law and Political Science of the said University, was enriched by five presentations. First to take the floor during the proceedings was Dr. Alexis NDZUENKEU, head of OHADA delegation. He addressed participants in English on the following topic: “OHADA and its Institutions: a Guarantee of Economic Growth in Africa”.
