Le créancier saisissant ne peut valablement fonder la saisie conservatoire des créances sur une ordonnance d'injonction dont la procédure d'opposition est encore pendante devant la juridiction compétente. Pareillement, lorsque l'exploit de dénonciation de la saisie ne contient pas mention du droit qui appartient au débiteur d'élever des contestations devant la juridiction du lieu de son domicile, c'est à bon droit que la juridiction compétente doit déclarer nul le procès verbal de saisie et ordonner mainlevée de la saisie irrégulièrement pratiquée.

International Congress on the Business Climate in Africa: Kinshasa to Host Inaugural Edition in 2026
