Aux termes de l'article 15 de l'ordonnance relative à la restructuration des établissements de crédit « toute action engagée à l'encontre d'un établissement de crédit en restructuration ou toute procédure d'exécution sur le patrimoine d'un tel établissement, est suspendue à compter de la date de publication de l'arrêté ordonnant la restructuration jusqu'à la date de publication de la décision mettant fin aux opérations de restructuration ».
A défaut de rapporter la preuve d'une décision mettant fin aux opérations de restructuration, c'est à bon droit donc que le premier juge a ordonné le sursis au paiement de la créance de l'appelant jusqu'à la date de publication de la décision constatant la fin des opérations de restructuration de l'intimé.

On Monday 14 April 2025, the OHADA Permanent Secretariat welcomed to its Headquarters in Yaoundé (Cameroon) students of the Master Programme in International Litigation of the Institute of International Relations of Cameroon (IRIC) and a delegation of the OHADA Club of the same Institute.
This event, organised by the Department of Business Law of the Faculty of Law and Political Science of the said University, was enriched by five presentations.
