Doit être déclarée irrecevable l'opposition formée contre une ordonnance d'injonction de payer si elle n'a pas été signifiée au créancier même si ce dernier comparaît devant le tribunal mais ne peut faire valoir ses moyens de défense contre l'opposition faute d'en connaître les motifs.
