Sociétés Commerciales - Sociétés Anonymes - Possibilité De Créer Un Poste De Vice-président à L'occasion De L'harmonisation Des Statuts Des Banques Et établissements Financiers (non)
Les dispositions de l'Acte uniforme sur les sociétés commerciales et le GIE étant d'ordre public, elles s'appliquent à toutes les sociétés commerciales, y compris aux banques et aux établissements financiers entrant dans cette définition juridique. Par suite, l'article 449 de cet Acte, relatif à la réglementation des cautions, avals, garanties et garanties à première demande, s'applique aux banques et aux établissements financiers.
Les dispositions de l'Acte uniforme étant d'ordre public et ne prévoyant pas la possibilité de créer un poste de vice-président pour l'administration d'une société anonyme, la création d'un tel poste pour les banques et établissements financiers constitués sous cette forme est impossible, fût-ce à l'occasion d'une harmonisation des statuts en application de l'article 909 AUSCGIE.

On Monday 14 April 2025, the OHADA Permanent Secretariat welcomed to its Headquarters in Yaoundé (Cameroon) students of the Master Programme in International Litigation of the Institute of International Relations of Cameroon (IRIC) and a delegation of the OHADA Club of the same Institute.
