Injonction De Payer - Opposition : Appel Contre La Décision Rendue Sur Opposition - Caractère D'ordre Public De L'article 15 De L'aupsrve - Irrecevabilité De L'appel Tardif
Il résulte de l'article 15 de l'AUPSRVE, dont les dispositions sont d'ordre public, que tout appel effectué plus de trente jours après le prononcé du jugement rendu sur opposition à une ordonnance d'injonction de payer est tardif et donc irrecevable. Les conditions de la violation de l'article 15 précité n'ont aucun effet sur la sanction encourue qui doit être prononcée d'office par la juridiction d'appel. En conséquence, l'arrêt d'appel qui a admis un appel interjeté plus de huit mois après le prononcé de la décision statuant sur l'opposition encourt la cassation sans qu'il soit besoin d'examiner la seconde branche du moyen de cassation. Sur évocation, irrecevabilité de l'appel tardif.

Monsieur Serge Christian Ekani a soutenu sa thèse de doctorat le 4 juin 2025 à l'Université Laval. Intitulée « L'effectivité du droit de l'OHADA à l'épreuve de la mondialisation de l'économie », la thèse a reçu les félicitations du jury et une recommandation de publication.

Le mardi 24 juin 2025 a eu lieu à l'Université Thomas SANKARA de Ouagadougou une soutenance de thèse en vue de l'obtention du Doctorat Unique portant sur « La saisies attribution des créances en droit OHADA ». Le jury, présidé par Pr Philippe DELEBECQUE de l'université paris I Sorbonne, avait en face de lui monsieur Valery Jean Prosper SILGA, magistrat et Secrétaire Permanent de la CNO-Burkina Faso.
