Le créancier bénéficiaire d'une inscription hypothécaire provisoire peut légitimement assigner son débiteur en validité de ladite inscription et demander sa transformation en hypothèque définitive s'il justifie du bien-fondé de sa créance. Si l'action en contestation de la créance est encore pendante devant la Cour d'appel, la juridiction saisie de l'action en transformation doit surseoir à statuer en attendant la décision de la Cour d'appel sur le bien-fondé de la créance.

On Monday 14 April 2025, the OHADA Permanent Secretariat welcomed to its Headquarters in Yaoundé (Cameroon) students of the Master Programme in International Litigation of the Institute of International Relations of Cameroon (IRIC) and a delegation of the OHADA Club of the same Institute.
This event, organised by the Department of Business Law of the Faculty of Law and Political Science of the said University, was enriched by five presentations. First to take the floor during the proceedings was Dr. Alexis NDZUENKEU, head of OHADA delegation. He addressed participants in English on the following topic: “OHADA and its Institutions: a Guarantee of Economic Growth in Africa”.
