Recouvrement Des Créances - Injonction De Payer - Créance - Créance Certaine - Créance Résultant Des Traites Impayées Et De L'engagement De La Caution - Absence De Preuve De Paiement Par Le Débiteur - Opposition Fondée (non)

Le débiteur qui prétend s'être acquitté de la totalité de sa dette doit rapporter la preuve du paiement allégué. En l'absence de cette preuve, la créance qui est certaine en ce qu'elle résulte de traitées impayées et d'un engagement de caution peut être recouvrée par la procédure d'injonction de payer et l'opposition du débiteur doit être déclarée non fondée par la juridiction compétente.
