Aux termes de l'article 28 AUPCAP, « la procédure collective peut être ouverte sur la demande d'un créancier, quelle que soit la nature de sa créance, pourvu qu'elle soit certaine, liquide et exigible.
L'assignation du créancier doit préciser la nature et le montant de sa créance et viser le titre sur lequel elle se fonde... ». Il en résulte que la saisie du Tribunal doit être faite par voie d'assignation, c'est-à-dire par exploit d'huissier, et non par requête.
En l'espèce, la société créancière a saisi le Tribunal par requête et non par assignation. Dans ces conditions, il y a lieu de déclarer irrecevable sa requête.
