Aux termes de l'article 13 AUPSRVE, celui qui a demandé la décision en injonction de payer supporte la charge de la preuve de sa créance.
En l'espèce, la demanderesse de la décision d'injonction de payer a produit un relevé de compte duquel il ressortait que l'appelante leur restait devoir une somme sur le montant de la créance initiale. La débitrice ne rapporte pas la preuve qu'elle a un solde moindre que le montant réclamé, la créance est donc fondée et il convient dès lors de la condamner à payer ladite somme.

On Monday 14 April 2025, the OHADA Permanent Secretariat welcomed to its Headquarters in Yaoundé (Cameroon) students of the Master Programme in International Litigation of the Institute of International Relations of Cameroon (IRIC) and a delegation of the OHADA Club of the same Institute.
