Il ressort des faits que les parties ont débuté leurs relations contractuelles en 1986 et ont connu leur début d'exécution en 1987. N'ayant payé qu'une partie de sa dette, le débiteur est assigné en paiement. Il invoque la prescription au sens de l'article 274 de l'AUDCG. La Cour estime que les opérations ayant donné lieu au litige s'étant passées bien avant l'entrée en vigueur de l'Acte uniforme de l'OHADA, seul est applicable le délai de prescription du Code de commerce et non celui de l'article 274 de l'Acte uniforme de l'OHADA relatif au droit commercial général.

On Monday 14 April 2025, the OHADA Permanent Secretariat welcomed to its Headquarters in Yaoundé (Cameroon) students of the Master Programme in International Litigation of the Institute of International Relations of Cameroon (IRIC) and a delegation of the OHADA Club of the same Institute.
