Droit Commercial General - Bail Commercial (non) - Expulsion - Application De L'article 101 Audcg (non)
Sollicitée pour infirmer l'ordonnance du Tribunal de Première instance qui a ordonné une expulsion, la Cour d'appel a débouté les requérants qui faisaient grief au premier juge d'avoir violé les dispositions de l'article 10 I de l'Acte uniforme sur le Droit Commercial Général.
Pour la Cour d'appel, le caractère de bail commercial n'apparaissait nulle part dans le contrat produit par l'appelant ; par conséquent ? il n'y avait pas lieu de faire application de l'article 10I. L'ordonnance querellée a donc été confirmée.

On Monday 14 April 2025, the OHADA Permanent Secretariat welcomed to its Headquarters in Yaoundé (Cameroon) students of the Master Programme in International Litigation of the Institute of International Relations of Cameroon (IRIC) and a delegation of the OHADA Club of the same Institute.
This event, organised by the Department of Business Law of the Faculty of Law and Political Science of the said University, was enriched by five presentations. First to take the floor during the proceedings was Dr. Alexis NDZUENKEU, head of OHADA delegation. He addressed participants in English on the following topic: “OHADA and its Institutions: a Guarantee of Economic Growth in Africa”.
