Est réputée bail commercial, toute convention, même non écrite, existant entre le propriétaire d'un immeuble compris dans le champ d'application de l'article 69 de l'Acte uniforme OHADA relatif au Droit commercial général, et toute personne physique ou morale permettant à cette dernière d'exploiter dans les lieux avec l'accord du propriétaire, toute activité commerciale, industrielle, artisanale ou professionnelle.
Dès lors, on ne peut obliger le locataire à signer un écrit sous astreinte.
Est devenue sans objet la demande de résiliation du contrat de bail et l'expulsion du locataire, dès lors que celui-ci a payé les loyers y compris ceux qui avaient motivé son expulsion.

On Monday 14 April 2025, the OHADA Permanent Secretariat welcomed to its Headquarters in Yaoundé (Cameroon) students of the Master Programme in International Litigation of the Institute of International Relations of Cameroon (IRIC) and a delegation of the OHADA Club of the same Institute.
