Injonction De Payer : Conditions De La Créance - Appréciation Par Les Juges Du Fond

Un moyen portant sur l'appréciation souveraine des faits par les juges du fond échappe au contrôle du juge de cassation. Il ne peut donc être reproché à une cour d'appel d'avoir manqué de base légale dans un tel cas.
C'est à tort qu'il est reproché à un arrêt d'appel d'avoir violé l'article 1 de l'AUPSRVE, alors qu'il ne ressort nulle part des énonciations de l'arrêt que la demanderesse a contesté le caractère de certitude, de liquidité et d'exigibilité de la créance, conditions appréciées par la cour qui a retenu que la créance remplissait les conditions d'une injonction de payer.
