Le moyen du pourvoi doit être déclaré irrecevable, dès lors que le moyen n'a pas été formulé devant le Tribunal de grande instance et l'est pour la première fois devant la CCJA.
Les dispositions de l'article 89 alinéa 3 AUPCAP ne s'appliquant que dans l'hypothèse où la juridiction compétente n'est pas en mesure de rendre une décision sur le fond avant la clôture de la procédure, le jugement n'a pas violé ledit texte et il y a lieu de rejeter le moyen, dès lors que le jugement critiqué s'est prononcé sur le fond de la créance de la requérante dont il a déclaré l'existence incertaine.

On Monday 14 April 2025, the OHADA Permanent Secretariat welcomed to its Headquarters in Yaoundé (Cameroon) students of the Master Programme in International Litigation of the Institute of International Relations of Cameroon (IRIC) and a delegation of the OHADA Club of the same Institute.
