Arbitrage - Constitution Du Tribunal Arbitral - Imparite Du Nombre Des Arbitres - Non Respect De L'imparite - Constitution Irreguliere Du Tribunal - Annulation De La Sentence
En présence de la règle de l'article 8 AUA qui impose l'imparité du nombre d'arbitres composant le tribunal, doit être annulée la sentence rendue par un tribunal arbitral composée de deux arbitres selon les termes de la convention d'arbitrage qui ne prévoit l'intervention d'un troisième arbitre que si les deux premiers ne sont pas d'accord sur les termes de la sentence à rendre.
Doit donc être cassé le jugement du tribunal qui annule la convention d'arbitrage prévoyant la parité au motif que celle-ci est incompatible avec l'article 8 AUA alors qu'il avait la possibilité d'y remédier en désignant un troisième arbitre.

On Monday 14 April 2025, the OHADA Permanent Secretariat welcomed to its Headquarters in Yaoundé (Cameroon) students of the Master Programme in International Litigation of the Institute of International Relations of Cameroon (IRIC) and a delegation of the OHADA Club of the same Institute.
This event, organised by the Department of Business Law of the Faculty of Law and Political Science of the said University, was enriched by five presentations. First to take the floor during the proceedings was Dr. Alexis NDZUENKEU, head of OHADA delegation. He addressed participants in English on the following topic: “OHADA and its Institutions: a Guarantee of Economic Growth in Africa”.
