Voies D'exécution - Exécution Entame : Impossibilité De Suspendre - Annulation De La Décision Ayant Suspendu Une Exécution Déjà Entamée
Il est constant qu'une exécution forcée entamée ne peut être suspendue. C'est donc en violation de l'article 32 de l'AUPSRVE qu'une cour d'appel a confirmé l'ordonnance ayant suspendu des saisies déjà pratiquées avant qu'elle n'ait été rendue, au moment où les tiers saisis étaient assignés au paiement des causes de la saisie, exposant ainsi son arrêt à la cassation.
Sur l'évocation, l'ordonnance du Premier Président de la Cour suprême a été rendue en violation de l'article 32 précité ; enfin l'ordonnance querellée ayant été frappée d'appel, son exécution était suspendue en l'absence de motivation spéciale conformément à l'article 172 de l'AUPSRVE. Il convient donc d'infirmer l'ordonnance entreprise et dire qu'il n'y a pas lieu à remettre les fonds à la disposition de la Compagnie Shell de Guinée.

On Monday 14 April 2025, the OHADA Permanent Secretariat welcomed to its Headquarters in Yaoundé (Cameroon) students of the Master Programme in International Litigation of the Institute of International Relations of Cameroon (IRIC) and a delegation of the OHADA Club of the same Institute.
This event, organised by the Department of Business Law of the Faculty of Law and Political Science of the said University, was enriched by five presentations.
