Recouvrement De Créance - Injonction De Payer - Créance - Caractère Certain Et Exigible (non) - Rétractation De L'ordonnance D'injonction De Payer (oui)
L'opposition à l'ordonnance d'injonction de payer doit être déclarée recevable, dès lors qu'elle a été faite conformément à l'article 11 de l'Acte uniforme portant organisation des procédures simplifiées de recouvrement et des voies d'exécution.
En déclarant le demandeur au pourvoi déchu de son droit d'opposition, la Cour d'appel a fait une mauvaise application de l'article précité et sa décision encourt la cassation.
Le jugement entrepris doit être infirmé et l'ordonnance d'injonction de payer rétractée, dès lors que la créance réclamée ne parait, en l'état, ni certaine, ni exigible au sens de l'article 1er de l'Acte uniforme portant organisation des procédures simplifiées de recouvrement et des vois d'exécution.

On Monday 14 April 2025, the OHADA Permanent Secretariat welcomed to its Headquarters in Yaoundé (Cameroon) students of the Master Programme in International Litigation of the Institute of International Relations of Cameroon (IRIC) and a delegation of the OHADA Club of the same Institute.
