OHADA Event / Stellenbosch South Africa, May 14-15, 2009
UNIDA / OHADA.com is pleased to report on the May 14-15, 2009 conference on « Mixed Jurisdictions as Models - Perspectives from South Africa and Beyond », held at the University of Stellenbosch, Stellenbosch, South Africa on May 14-15, 2009. The sponsors were: the International Academy of Legal Science, and the World Society of Mixed Jurisdiction Jurists.
Among the speakers, three spoke extensively about OHADA. For two of these, the mixed jurisdiction in question was Cameroon, a bijural and bilingual country that incorporates OHADA and its Uniform Acts within, inter alia, an English-language, common-law legal system. Dr. Tumnde Martha, née Njikam, Dean of the Faculty of Social and Management Sciences at the University of Buea in Cameroon, spoke about the common-law trained lawyers' experiences working with OHADA, and Prof. Claire Moore Dickerson, Sen. John B. Breaux, Prof. of Law at Tulane University, New Orleans, LA, USA, focused on the influence of local business norms on the interpretation of the OHADA Uniform Acts. A third speaker, Dr. Christa Roodt of Aberdeen University in Scotland, another mixed jurisdiction, and formerly of South Africa, a mixed jurisdiction as well, discussed arbitration in Africa, and included a detailed review of the OHADA arbitral regime under the Uniform Act on Arbitration.
