ERSUMA - OHADA / STUDY ON “The economic significance of Uniform Acts”: Call for applications for the selection of researchers
Pursuant to the OHADA Treaty signed in Port Louis on October 17, 1993 and revised in Quebec on October 17, 2008, ten (10) Uniform Acts have been adopted and have entered into force to date. Some of them have already been revised while others are in the process. These various legislative movements are within the framework of the reform which is necessary for the realization of the OHADA goals. To achieve this, there have been evaluations to identify those provisions that require legislative intervention.
The adoption or revision of the laws produced by OHADA respond to a global need for economic development of Member States. Indeed, the legal and judicial security sought by OHADA through its laws is intended to promote the development of economic activities and investment. OHADA Law therefore clearly becomes a tool for economic development and as such, the revisions of Uniform Acts basically seek to achieve specific goals. The relevant question is therefore whether such goals are achieved?
Although studies have been conducted to assess the level of attractiveness of the OHADA Law, comprehensive statistics on the impact of OHADA Law on the economic development of Member States are not available. Yet, only such statistical data can make a valuable contribution to the policy orientation of Member States in tackling economic development issues.
In order to contribute to the assessment of the OHADA rules impact on the economic development objectives of Member States and to improve the investment climate, ERSUMA is considering a study of one (01) year duration on “The Economic Significance of OHADA Law”.
In this framework, the ERSUMA Research Center is launching a call for applications for the recruitment of researchers. Each Member State will be covered by a national research team of seven (07) persons, led by a coordinator assisted by a rapporteur.
Any person fulfilling the conditions to be associate researcher, visiting fellow or intern at ERSUMA in accordance with the Researcher's Charter of ERSUMA (http://www.ohada.org/attachments/article/2365/DECISION-CHARTE-DU-CHERCHEUR-ERSUMA.pdf) may be a member of the research team for the realization of the above referenced study.
Only persons eligible to be associate researcher or visiting fellow may be coordinator or rapporteur.
Candidates may apply individually or in a team of seven (07) people.
Research centers or research consortia in the OHADA space may also apply, specifying the country or countries to be covered; applications must also indicate the profile of proposed researchers.
Selected candidates shall:
- Assess the uniform application of the ten (10) Uniform Acts in each of the seventeen OHADA Member States;
- Highlight the functionality of the CCJA and the Judicial Organization of the OHADA Member States;
- Measure the economic significance of the OHADA Uniform Acts;
- Identify and classify the various domains and rules according to their economic significance;
- Identify the obstacles to the effective economic significance of Uniform Acts;
- Compile and analyze statistics on the application of Uniform Acts;
- Propose, where appropriate, a redefinition of the nature and roles of the various actors involved in the economic significance of Uniform Acts;
- Define ways of improving the economic significance of Uniform Acts;
- Contribute to the orientation of legislative and regulatory policies and the improvement of the public service of justice in the OHADA space;
Candidates must:
- Have sound knowledge of the OHADA Uniform Acts;
- Be able to integrate a research or laboratory center;
- Have mastery of the computer tool preferably, Office suite 2017;
- Have knowledge of one of the official languages of OHADA (French, English, Portuguese, Spanish).
- The application file includes:
- A motivation letter to the Director General of the ERSUMA;
- A detailed curriculum vitae including a list of areas of expertise, a list of publications and a summary presentation of the researcher;
- A criminal record of less than three (03) months old or any other document in lieu thereof;
- A legalized copy of diplomas and / or certificates obtained.
At the end of the selection, a researcher contract will be signed between ERSUMA and the researcher and will include among others, the rights and obligations of the parties.
