OHADA-RD CONGO / Training procedure for recovery of customer receivables in OHADA law with microfinance organizations and other professionals concerned

Announcement of the Dynamics of Lawyers and Professionals of Space Law OHADA (DJPOHADA)

A key player in DR Congo in the organization of high-level training seminars, with several practical training sessions attended by professionals of various stature, the Dynamics of Lawyers and Professionals of Space Law OHADA, DJPOHADA in acronym, organizes very soon in Kinshasa, from 06 to 07 July 2017, every two days from 09:30 to 15:30, Conference Room of the Hotel AFRICAN DREAM - Ref. Boulevard du 30 juin - Rond-Point MANDELA - C / Gombe, a training seminar devoted to the following theme: “MICROFINANCES AND TECHNIQUES FOR THE LEGAL RECOVERY OF RECEIVABLES: TO MAINTAIN GOOD PRACTICES FOR THE RECOVERY OF CLIENT RECEIVABLES IN THE OHADA AREA OF THE AMIABLE PHASE TO THE FORCED PHASE”.

Indeed, the establishment of collection procedures has become essential in microfinance institutions (banks and credit institutions). The main concern is to favor the techniques of amicable recovery to the displeasure of so-called forced and judicial ones; Although in certain assumptions or cases of debtor clients, forced techniques may prove most effective in countering any bad faith or the organization of insolvency. The proposed training takes into account the administrative and psychological legal aspects related to the recovery process.

Whether amicable or litigious, debt collection offers a wide range of actions to recover its debts. This is why it is important to control all possible options so as to anticipate not only the choice but also the order in which the different approaches will be initiated and thus optimize its chances of recovery.

But how to optimize your recovery processes? What measures should be put in place to ensure rigorous, professional and, above all, legislative follow-up? What is the best collection technique best suited to your business and what are its chances of success? This training seminar on recovery procedures will allow you to understand the functioning of the recovery and to identify the axes to work for a better return in the company.

Apart from the fact that our trainings are built around concrete cases brought by the participants, which will serve as illustration and support for the group work, they will have the advantage of receiving a certificate of formation signed by our experts and speakers, A documentary kit which will include in particular all the materials of the seminar, including if OHADA law books dealing with the question.

As the training is very practical, participants will be able to bring performance to their services and evaluate their usual practices before setting up effective and optimized debt recovery procedures.

To address this issue, DJPOHADA will involve three expert practitioners specialized in pre-litigation and judicial recovery procedures:

  • Mr. Patrice BUABUA, General Secretary and Legal Director of Fibank DRC, Chairman of the Congolese Banking Association of the Congolese Banking Association, practitioner of enforcement procedures OHADA, Member of the OHADA National Commission in DR Congo;
  • Mr. Roger MULAMBA KATAMBA, Lawyer at the Kinshasa-Matete Bar, Arbitrator at the CCJA Arbitration Center (OHADA) in Abidjan. He is Associate-Manager at the RMK & Associés of Kinshasa. OHADA Pathway Practitioner and expert on microfinance receivables;
  • Mr. Jean-Didier BAKALA DIBANSILA, Lawyer at the Bar of Matadi in RD Congo. A researcher, he teaches practical work at the Faculty of Law of the Protestant University of Congo (UPC). He is also an expert practitioner of the OHADA execution channels and expert in the recovery of accounts receivable from microfinance organizations. He has several publications in this field.

Registration fees include coffee breaks and lunches (buffets), a certificate of participation at the end of the course, a documentary kit which will include all the materials of the seminar.

The training will be conducted in French.

  • MODULE 3 - FRIENDLY RECOVERY PROCESSES
  • MODULE 4 - FORCED RECOVERY
  • MODULE 5 - KNOWING THE PRACTICAL DIFFICULTIES OF THE BANKER IN THE TREATMENT OF SEIZURES-ATTRIBUTIONS
