Training on “The Creation of Securities and other Guarantees in OHADA Space and Related Litigations”: ERSUMA, from 5 to 9 December 2016 in Porto-Novo (Republic of Benin)

The Higher Regional School of Magistracy (ERSUMA) of the Organization for the Harmonization of Business Law in Africa (OHADA) is organizing a training on “The Creation of Securities and other Guarantees in OHADA Space and Related Litigations” from 5 to 9 December 2016 at its headquarters in Porto-Novo ( Republic of Benin).

Financed by the World Bank Group, especially the Investment Climate Improvement Project (PACI), this training is specifically aimed at:

• Revisiting the major innovations from the reform of the OHADA Uniform Act on securities;
• Exploring and specifying how securities should be registered;
• Reviewing the general case law on securities;
• Taking stock of litigations relating to the OHADA law on securities, especially those related to the Uniform Act on Simplified Debt Recovery procedures and Enforcement Measures as well as the attachment of bank accounts;
• Addressing the issue of debts exempted from seizure that are paid into the attached accounts;
• Analyzing the effects of payment by a garnishee when a bank account has been attached;
• Giving some tricks for a better effectiveness of securities that can help facilitate the recovery of a debt which is secured.

This training will be attended mainly by Magistrates, Lawyers; Notaries; Registrars and Bailiffs of the 17 Member States of OHADA for a total of eighty-five (85) participants at a rate of five (05) per Member State.

It is also open for payment to any other interested person in accordance with the directives of the ERSUMA Governing Board and the Board of Directors. Participation conditions in this respect will be specified on the website of OHADA www.ohada.org or on request at ersuma@ohada.org.

The training will be provided by two ERSUMA trainers.
