Commerçant - Acte De Commerce - Pharmacien - Actes Accomplis à L'occasion De L'activité De Pharmacien : Prescription Quinquennale

Un pharmacien et une banque ont tous les deux la qualité de commerçant ; les actes accomplis par eux et les obligations qu'ils assument entre eux ou à l'égard d'autres personnes entrent bien dans le champ de l'article 18 [devenu 16] de l'AUDCG. S'agissant d'une action en justice pour avoir paiement d'une somme objet de leurs transactions, peu importe la forme en laquelle l'obligation a été constatée, elle tombe sous le coup de la prescription quinquennale et le pourvoi doit être rejeté.

International Congress on the Business Climate in Africa: Kinshasa to Host Inaugural Edition in 2026
